1. Agreement to Terms

By accessing or using Honest Stake, you agree to these Terms of Service. This is a binding agreement between you and Honest Stake, LLC. If you do not agree, you may not use the service.

2. Service Description (Conditional Pricing Model)

Honest Stake is a productivity utility that utilizes a 'Conditional Pricing' model to enforce discipline. By using the service, you agree to the following mechanics:

  • The Service: Honest Stake provides automated accountability tracking, deadline enforcement, and performance verification.
  • The Stake (Service Fee): When you create a commitment, you define a monetary amount (the 'Stake'). This amount represents the agreed-upon price for the accountability service for that specific goal.
  • Conditional Waiver: Honest Stake agrees to waive 100% of this service fee for every check-in you successfully complete on time.
  • Fee Enforcement: If you miss a check-in or deadline, the waiver for that check-in is voided and a charge is applied. Total charges for a commitment never exceed your total Stake.

3. Access & Billing

Free Access + Optional Subscription

  • Access to the core platform is free and includes 3 active commitments at a time.
  • Honest Stake Pro is an optional monthly subscription that unlocks unlimited active commitments and Pro-labeled features.
  • You are only charged a Stake when you fail to meet the commitments you explicitly created.

Payment Method Requirement

  • To create commitments, you must maintain a valid credit or debit card on file.
  • Honest Stake validates this card via Stripe but does not hold funds in escrow. Charges are only processed post-failure.

4. Authorization & Refunds

Explicit Authorization

By clicking 'Activate Commitment' (or similar), you explicitly authorize Honest Stake to charge your saved payment method for missed or failed check-ins, up to your total Stake.

No Refunds Policy

  • Due to the nature of the service (Commitment Device), all charges are final.
  • You acknowledge that a missed check-in constitutes full delivery of the service (the consequence), and therefore the fee is non-refundable.
  • We do not offer refunds for 'forgetting' to check in, technical issues on your end (e.g., dead battery), or personal emergencies. The strictness of the system is the product.

Disputes & Chargebacks

  • Attempting to dispute a valid charge (Chargeback Fraud) constitutes a violation of these terms.
  • We reserve the right to ban users who initiate fraudulent disputes and may submit evidence of your explicit authorization to your bank.

5. Commitment & Check-In Rules

Immutability

Once a commitment is activated, its parameters (Stake amount, frequency, duration, and timezone) cannot be changed. This ensures the integrity of the accountability mechanism.

Deadlines are Absolute

Our system's server clock is the final authority on deadlines. Missing a deadline by even one minute is classified as a failure. There are no excuses or manual overrides.

6. User Responsibilities

  • Honesty: You agree to report your check-ins truthfully.
  • Payment Validity: You must ensure your payment method has sufficient funds to cover potential stakes.
  • Security: You are responsible for maintaining the security of your account and device.

7. Prohibited Uses

  • Developing illegal or harmful commitments.
  • Attempting to circumvent the payment or verification system.
  • Using the service for gambling or speculative purposes.
  • Automating check-ins via bots or scripts.

8. Disclaimers & Nature of Service

Not a Gambling Service

Honest Stake is NOT a gambling service. There is no element of chance, luck, or randomization. The outcome of your commitment depends entirely on your own skill, willpower, and physical actions. You cannot 'win' money; you can only save your own money by fulfilling your obligations.

No Professional Advice

We do not provide medical, psychological, or legal advice. If your commitments involve health or lifestyle changes, consult a professional first.

Service 'As Is'

The service is provided 'as is'. While we strive for 100% uptime, we are not liable for technical failures that prevent a check-in. It is your responsibility to check in early to avoid last-minute issues.

9. Limitation of Liability

To the maximum extent permitted by law, Honest Stake, LLC shall not be liable for any funds lost due to your failure to meet your self-defined commitments. By using the service, you agree that the 'loss' of the Stake is a voluntary payment for the enforcement service provided.

10. Governing Law

These Terms are governed by the laws of the State of Delaware, United States. Any disputes shall be resolved through binding arbitration in Delaware.
